Terms and Conditions

for the Provision of Private Tuition

1. THE CONTRACT

1.1. These Terms of Business constitute the contract between Alpha Training and the Parent/Guardian for the supply of the services of Alpha Training in the organisation of the provision of professional educational guidance.

1.2. Unless otherwise agreed in writing the Centre Manager of Alpha Training, these Terms of Business shall prevail over any other terms of business or purchase conditions put forward by the Parent/Guardian.

1.3. No variation or alteration of these Terms of Business shall be valid unless approved in writing by the Centre Manager of Alpha Training.

2. SUITABILITY AND REFERENCES

2.1. Alpha Training endeavours to ensure the suitability of any Teacher supplied to the Parent/Guardian by only supplying Teachers who have been selected through interview and by taking up references.

3. FEES

3.1. The current hourly fee for classroom sessions is between £12 - £15 for each teaching session depending on the subject for up to 50min. Tuition will be charged to the nearest quarter of an hour.

3.2. One to One private Tuition by Alpha Training will be charged between £35 - £45 per for each teaching session depending on the subject for up to 50min. Tuition will be charged to the nearest quarter of an hour.

3.3. If a pupil is required to be taught on a one-to-one basis in the Alpha Training Offices a £20 per hour room charge will be applied in addition to the tuition fee.

3.4. No refund of booking fees is payable should Alpha Training be restructured, merged, transferred, or closed. 3.5. Payments are due 7 days prior to the lessons. If payment has not been received Alpha Training reserves the right to withdraw their teacher.

3.5. Payments are made a minimum of 4 weeks in advance for bookings unless agreed otherwise eg for 2 lesson a week; 8 payments are due prior to the first session.

4. CANCELLATION FEES A) FOR PRIVATE TUITION

4.1. If the booking is cancelled with at least 48 hours’ notice there will be no charges applicable for the Teacher.

4.2. If the Parent/Guardian cancels with less than 48 hours’ notice, the Parent/Guardian must pay Alpha Training the hourly fee for the Teaching session, from which Alpha Training must pay the Teacher.

5. CONDITIONS

5.1 The Parent/Guardian undertakes to make all bookings with Teachers exclusively through Alpha Training.

5.2 The Parent/Guardian undertakes to respect the Teacher’s right to privacy and agrees not to ask any Teacher for a phone number or contact address other than through Alpha Training.

5.3 Alpha Training may decline at any time to arrange an Assignment if the Parent/Guardian does not observe any of these Conditions or at its discretion.

6. LIABILITY

6.1 Whilst every effort is made by Alpha Training to give satisfaction to the Parent/Guardian by ensuring reasonable standards of skills, integrity and reliability from Teachers and further to provide them in accordance with the Parent/Guardian’s booking details, Alpha Training is not liable for any loss, expense, damage or delay arising from any failure to provide any Teacher for all or part of the period of booking or from the negligence, dishonesty, misconduct, accidental damage to property during the assignment or lack of skill of the Teacher. For the avoidance of doubt, Alpha Training does not exclude liability for death or personal injury arising from its own negligence.

6.2 Teachers are engaged by Alpha Training under contracts for services and are deemed to be under the supervision, direction and control of the Parent/Guardian from the time they report to take up duties and for the duration of the Assignment. The Parent/Guardian agrees to be responsible for all acts, errors or omissions of the Teacher, whether wilful, negligent or otherwise as though he was on the payroll of the Parent/Guardian. The Parent/Guardian will also comply in all respects with all statutes including, for the avoidance of doubt, the Working Time Regulations, Health and Safety At Work Act etc, by-laws, codes of practice and legal requirements to which the Parent/Guardian is ordinarily subject in respect of the Parent/Guardian’s own staff, including in particular the provision of adequate Employer’s and Public Liability Insurance cover for the Teacher during all Assignments.

6.3 The Parent/Guardian shall advise Alpha Training of any special health and safety matters about which Alpha Training is required to inform the Teacher. The Parent/Guardian will assist Alpha Training in complying with Alpha Training’s duties under the Working Time Regulations by supplying any relevant information about the Assignment requested by Alpha Training and the Parent/Guardian will not do anything to cause Alpha Training to be in breach of its obligations under these Regulations. Where the Parent/Guardian requires or may require the services of a Teacher for more than 48 hours in any week, the Parent/Guardian must notify Alpha Training of this requirement before the commencement of that week.

6.4 The Parent/Guardian shall indemnify and keep indemnified Alpha Training against any costs, claims or liabilities incurred by Alpha Training arising out of any Assignment or arising out of any non-compliance with clause 8.2 and 8.3 and/or as a result of any breach of these Terms by the Parent/Guardian.

8. TERMINATION

8.1 The Parent/Guardian undertakes to supervise the Teacher sufficiently to ensure the Parent/Guardian’s satisfaction with the Teacher’s standards of workmanship. If the Parent/Guardian reasonably considers that the services of the Teacher are unsatisfactory, the Parent/Guardian may terminate the Assignment either by instructing the Teacher to leave the Assignment immediately, or by directing Alpha Training to remove the Teacher. Alpha Training may in such circumstances reduce or cancel the charges for the time worked by that Teacher, provided that notification of the unsuitability of the Worker is confirmed in writing to Alpha Training within 48 hours of the termination of the Assignment.

8.2 The Parent/Guardian shall notify Alpha Training immediately and without delay and in any event within 24 hours if the Teacher fails to attend work or notifies the Parent/Guardian that he is unable to attend work for any reason.

9. LAW

9.1 These Terms are governed by the law of England and are subject to the exclusive jurisdiction of the Courts of England.
